What Is the Licence Appeal Tribunal?

The Licence Appeal Tribunal is an independent, quasi-judicial tribunal established under the Licence Appeal Tribunal Act, 1999. It operates as part of Tribunals Ontario and hears appeals and applications related to licences and compensation claims regulated by the provincial government.

The LAT has two divisions. The General Service division handles driving appeals, business licence appeals, consumer compensation claims, and compliance order appeals across a wide range of regulated industries. This is the division we practice in.

Types of LAT Appeals We Handle

Driver’s Licence Suspensions and Downgrades

If your licence has been suspended or downgraded for medical reasons under the Highway Traffic Act, you have the right to appeal to the LAT. Your livelihood, your independence, and your ability to care for your family may all depend on your licence. For medical suspension and downgrade appeals, the LAT typically schedules a hearing within 13 days of receiving a complete application. Moving quickly and filing correctly matters.

If your vehicle was impounded under the Highway Traffic Act because a driver with a suspended licence was operating it, you may have grounds to appeal. To succeed, you need to demonstrate that you took reasonable steps to confirm the driver was properly licensed, or that losing the vehicle would cause exceptional hardship as defined under the regulations.
